Terms of Service
These Terms of Service govern your access to and use of Musicians Network. By creating an account, browsing the website, using our services, or purchasing a paid plan, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use Musicians Network.
1. Who we are
Musicians Network is operated by The Skills Network LLC, a California limited liability company. In these Terms, "Musicians Network," "we," "us," and "our" refer to The Skills Network LLC and the Musicians Network website, mobile experiences, features, profiles, listings, messages, business pages, and related services.
2. Eligibility
You must be at least 18 years old to create an account or use Musicians Network. By using the service, you confirm that you are at least 18 and that you have the legal authority to agree to these Terms. If you are using Musicians Network on behalf of a business, music store, school, venue, band, or other organization, you confirm that you are authorized to act for that organization.
3. Accounts and security
You are responsible for the information you provide and for keeping your login credentials secure. You agree to provide accurate account information, keep it reasonably up to date, and notify us if you believe your account has been accessed without authorization. You may not create fake accounts, impersonate another person or business, or use another user's account without permission.
4. Profiles, visibility, and connections
Musicians Network helps musicians, bands, teachers, music stores, and music-related businesses be discovered and connect. Some profile information, posts, listings, business pages, images, instruments, music styles, city or region, and other content you choose to publish may be visible to other users or to the public, depending on the feature and your settings.
You are responsible for deciding what to share. Do not publish personal information that you do not want others to see.
5. User content
"User Content" means content that users submit, upload, post, list, message, or otherwise provide through Musicians Network, including profile information, photos, logos, posts, listings, band information, store information, teacher information, messages, comments, and other materials.
You keep ownership of your User Content. By submitting User Content, you grant Musicians Network a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, format, adapt for technical purposes, distribute, and make your User Content available as needed to operate, improve, protect, and promote Musicians Network and the features you choose to use.
We will not claim ownership of your music, recordings, photos, trademarks, logos, or creative work. If we want to use your content in advertising or founder-led promotional materials outside normal platform display, we will either rely on content you have made publicly available for that purpose or seek appropriate permission where needed.
6. Your responsibilities
You agree that you will not:
- harass, threaten, abuse, stalk, discriminate against, or exploit any person;
- post false, misleading, defamatory, hateful, sexually explicit, violent, illegal, or infringing content;
- send spam, scams, phishing messages, fake opportunities, or deceptive business solicitations;
- scrape, copy, harvest, or misuse user data, profiles, messages, or listings;
- upload viruses, malware, or code designed to disrupt the service;
- attempt to bypass security, rate limits, moderation, account restrictions, or payment systems;
- sell, rent, or transfer your account without our permission;
- use Musicians Network for illegal activity or to violate another person's rights.
7. Messaging and offline interactions
Musicians Network may allow users to discover, contact, and message each other. We do not guarantee the identity, background, skills, availability, safety, honesty, or suitability of any user, band, teacher, store, business, listing, opportunity, or event.
Use good judgment when communicating with others or meeting in person. Meet in public places when appropriate, tell someone where you are going, protect your personal and financial information, and report suspicious behavior.
8. Music stores, business accounts, and local advertising
Musicians Network may allow music stores, teachers, bands, venues, schools, service providers, and other music-related businesses to create business pages, claim listings, publish information, or purchase paid visibility. Businesses are responsible for the accuracy of their information, pricing, availability, offers, images, trademarks, and claims.
We may review, approve, reject, edit, suspend, or remove business pages, ads, listings, or claims that violate these Terms, harm users, create confusion, or do not fit the purpose of Musicians Network.
9. Paid plans, payments, cancellation, and refunds
Musicians Network may offer free features and paid plans, including business plans, promotional placements, or other paid services. Prices, features, billing cycles, taxes, renewal rules, and cancellation options will be shown at checkout or in the relevant plan description.
If a paid plan renews automatically, we will describe the renewal terms before purchase where required by law. You are responsible for canceling before renewal if you do not want the plan to continue. Cancellation stops future billing but does not automatically refund amounts already paid unless required by law or stated in the applicable offer.
Payments may be processed by third-party providers such as PayPal, Apple, Google, Stripe, or other payment processors. Your use of those payment services may be subject to their separate terms and policies.
10. Moderation, reports, and enforcement
We may review, remove, restrict, suspend, or terminate accounts, content, messages, listings, business pages, or paid placements if we believe they violate these Terms, create risk for users, create legal exposure, damage the service, or are inconsistent with the purpose of Musicians Network.
We may also preserve or disclose information if we believe it is reasonably necessary to comply with law, enforce these Terms, respond to claims, prevent fraud or security issues, or protect users, the public, or Musicians Network.
11. Intellectual property
Musicians Network, including its name, logo, design, software, database structure, features, graphics, and brand elements, is owned by The Skills Network LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer our service except as allowed by law or with our written permission.
You must only upload content you own or have permission to use. If you believe content on Musicians Network infringes your copyright or trademark rights, contact us through our contact form with enough information for us to review the claim.
12. Third-party services and links
Musicians Network may include links, integrations, maps, analytics, payment systems, social features, app platforms, Google Places, Google Analytics, PayPal, Apple, Google, and other third-party services. We do not control those third parties and are not responsible for their content, practices, availability, or policies.
13. Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. By using Musicians Network, you acknowledge the Privacy Policy.
14. Changes to the service or Terms
We may update Musicians Network and these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as posting the updated Terms, changing the "Last updated" date, or providing in-product or email notice. Your continued use of Musicians Network after changes become effective means you accept the updated Terms.
15. Termination
You may stop using Musicians Network at any time. You may request account deletion through available account tools or by contacting us. We may suspend or terminate your account if we believe you violated these Terms, created risk, or misused the service. Some provisions, including intellectual property, user content licenses already granted for service operation, payment obligations, disclaimers, limitations of liability, and dispute provisions, will survive termination.
16. Disclaimers
Musicians Network is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, secure, error-free, or always available. We do not guarantee that users will find bandmates, gigs, teachers, students, stores, customers, jobs, revenue, events, or successful collaborations.
We do not verify every user, business, listing, credential, offer, message, or claim. You are responsible for your decisions, communications, purchases, collaborations, and offline interactions.
17. Limitation of liability
To the fullest extent permitted by law, Musicians Network and The Skills Network LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, opportunities, or business, arising from or related to your use of the service.
To the fullest extent permitted by law, our total liability for any claim related to the service will be limited to the amount you paid us for the service giving rise to the claim during the three months before the event giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.
18. Indemnity
You agree to defend, indemnify, and hold harmless The Skills Network LLC, Musicians Network, and their owners, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of the service, your violation of these Terms, or your violation of any law or third-party right.
19. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be handled in the state or federal courts located in California, unless applicable law requires a different forum.
